Terms of Service

1Agreement

These Terms of Service (“Terms”) are a binding agreement between you and Appystrano LLC (“we”, “us”), the publisher of the Cue & Capture iPhone application (the “App”). By downloading, subscribing to or using the App you agree to these Terms. If you do not agree, do not use the App.

Apple's Licensed Application End User License Agreement (the “Standard EULA”) also applies to your use of the App. These Terms are additional to it. Where these Terms give you rights beyond the Standard EULA, these Terms apply; where the two genuinely conflict on a point the Standard EULA covers, the Standard EULA governs.

2Apple's role

You acknowledge that:

• these Terms are between you and Appystrano LLC only, and not with Apple. We, not Apple, are solely responsible for the App and its content;
• Apple has no obligation to provide maintenance or support for the App;
• if the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App;
• we, not Apple, are responsible for addressing any claim by you or a third party relating to the App, including product liability, legal or regulatory non-compliance, and consumer protection claims;
• we, not Apple, are responsible for investigating and resolving any third-party claim that the App infringes that party's intellectual property rights;
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

3Who may use the app

You must be at least 18 years old, or the age of majority where you live, to subscribe. The App is a professional tool intended for working and aspiring wedding photographers.

4Subscriptions and free trial

The App is subscription-based. There is no free tier: after the free trial ends, an active subscription is required to continue using the App.

• Free trial. New subscribers receive a 7-day free trial. If you cancel before the trial ends you are not charged.
• Plans and price. Monthly at $9.99 per month, or annual at $59.99 per year, in US dollars. Prices in other regions are set by Apple's pricing tiers and shown to you before you confirm.
• Automatic renewal. Subscriptions renew automatically at the end of each period unless auto-renewal is turned off at least 24 hours before the end of the current period.
• Billing. Your Apple Account is charged for renewal within 24 hours before the end of the current period, at the then-current price for your plan.
• Managing your subscription. You can view, change or cancel your subscription at any time in Settings › your name › Subscriptions on your device. Deleting the App does not cancel a subscription.
• Price changes. If we change the price of a plan, Apple will notify you and ask for your consent before the new price takes effect, as required by the App Store.

5Refunds

All purchases are made through the App Store, so Apple handles billing and refunds, under Apple's Media Services Terms. We cannot issue, approve or reverse a charge on your Apple Account. Refund requests go to reportaproblem.apple.com. If something has gone wrong, please still tell us — we would rather fix it.

6Your licence

While your subscription is active, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the App and its content for your own photography practice — including using the posing instruction on real shoots, whether for your own clients or as an employee.

This licence is for one person. It does not extend to your studio, your team or your students as a group; each individual needs their own subscription.

7Restrictions

You may not:

• copy, download, screenshot, republish or redistribute the photographs, written coaching content or workshop video, whether publicly or privately;
• resell, sublicense, rent or share your access, or let others use your Apple Account to obtain access;
• use the content to build, train or populate a competing posing library, course or dataset, including for machine-learning purposes;
• scrape, crawl or bulk-extract content, or attempt to access it other than through the App's ordinary interface;
• reverse engineer, decompile or attempt to derive source code, except where that restriction is prohibited by law;
• remove or obscure any copyright, credit or proprietary notice.

Using a pose you learned on a real wedding is the entire point and is expressly encouraged. Passing our photographs off as your own work is not.

8Intellectual property

All content in the App is protected by copyright and other laws, and remains the property of its owners:

• the wedding photographs are © Lin & Jirsa Photography;
• the workshop video and the Foundation Posing curriculum are © SLR Lounge;
• the App itself, its written coaching content, the Cue & Capture name and the CC monogram are © 2026 Appystrano LLC.

Nothing in these Terms transfers ownership of any of it to you.

9Educational content

The App is educational. It teaches a posing system, technique and professional judgement. It is not a guarantee of any particular commercial result, booking rate or standard of photograph, and nothing in it is business, legal or financial advice. What you produce on a shoot remains your responsibility, as does your relationship with your own clients.

10Availability and changes

We aim to keep the App available and to add content over time, but we do not guarantee uninterrupted availability. We may add, change or remove features and content, and may discontinue the App. If we discontinue it entirely, we will stop charging subscriptions and give reasonable notice.

11Disclaimer of warranties

To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted operation.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these Terms limits rights you have under mandatory consumer protection law.

12Limitation of liability

To the maximum extent permitted by law, Appystrano LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost bookings, lost data or business interruption, arising out of or relating to your use of the App — even if we have been advised of the possibility.

Our total aggregate liability arising out of or relating to the App or these Terms will not exceed the greater of (a) the amount you paid us for the App in the twelve months before the claim, or (b) fifty US dollars ($50).

13Indemnification

You agree to indemnify and hold harmless Appystrano LLC and its members, officers and contractors from any claim, damage, loss or expense (including reasonable legal fees) arising out of your misuse of the App, your breach of these Terms, or your violation of any law or third-party right.

14Termination

You may stop using the App at any time by cancelling your subscription and deleting the App. We may suspend or terminate your access if you materially breach these Terms, in particular the restrictions in section 7. Sections 7, 8 and 11 through 15 survive termination.

15Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state and federal courts located in Orange County, California, and you and we consent to personal jurisdiction there.

If you are a consumer resident in the European Union, the United Kingdom or another jurisdiction whose law gives you the right to bring proceedings locally, nothing here removes that right.

16Changes to these terms

We may update these Terms as the App changes — for example when user accounts are introduced. We will change the effective date at the top of this page and, for material changes, give notice inside the App. Continuing to use the App after a change takes effect means you accept the revised Terms.
